Marriage Green Card: Marriage Fraud Interview

In order to obtain immigration benefits available to a spouse, there must be a valid marriage between the parties. In most situations, a marriage is valid for immigration purpose if it is recognized by the law of the state where it occurs. However, a marriage that is legally valid may still be disregarded if it is found to be a sham marriage, entered into by the parties to obtain immigration benefits and without any intention to live together as husband and wife.

The burden is on the applicant to demonstrate the bona fides of the marriage.  During the marriage green card process, the USCIS will interview both the husband and the wife.  In some cases, exceptions can be made and no interview takes place.  However, this is extremely rare.  If the USCIS has reason to suspect that the marriage is a sham marriage, then they will conduct a special fraud interview.  This will include separation of the parties and conducting a question and answer session under oath.  If the interviewing officer believes the marriage is a sham, the USCIS may

1) Deny the application and subsequent applications pursuant to INA 204(c);

2) Institute removal proceedings;

3) Refer for visa fraud prosecution pursuant to 18 USC Section 1546;

4) Refer to perjury prosecution pursuant to 18 USC Section 1001;

5) Refer for conspiracy prosecution pursuant to 18 USC Section 371; and

6) Refer for marriage fraud prosecution pursuant to INA Section 275(c).

Prior to the interview, the USCIS will conduct an investigation of the parties.  Specifically, they will run a criminal background check, a credit check and will search the internet for any postings the parties may have made.  This includes popular social sites like Myspace and Facebook.  The USCIS will be looking for any evidence that the parties do not intend to live as husband and wife.  When questioned at the interview, any inconsistent statements may be used as a basis to deny the application.

The focus of the interview will be to determine if the parties intend to establish a married life together.  The parties will be asked to present evidence that they have been living as a married couple.  This is normally shown by producing evidence of insurance policies, property, leases, income tax statement and bank accounts that are jointly held.  Photos and birth certificates of children born to the parties are helpful as well.

There are many factors the USCIS will look at to determine the existence of a sham marriage.  A sham marriage is a marriage that was fraudulent at its inception.  A marriage is not a sham or fraudulent marriage if the couple intended to live as husband and wife but later grew apart.

Because USCIS may use any inconsitency against the applicant to deny the green card application, it is vitally important for the parties to be properly represented and prepared.

  1. Most recently, I was eagerly awaiting the interview as an opportunity to discuss my husband and my wonderful relationship. I thought it would be a pleasant experience, quick and painless. Little did I know that based on “what have you” we had been pinpointed as a “fraud interview” which is perhaps the most uncomfortable situation I’ve ever been in in my almost 40 years of existence, I was left so traumatized by the experienced that I couldn’t sleep afterwards. I had no idea that we were profiled as fraud, as such we ended up staying for a 4.5 hours back and forth interview with 2 different officers and not at the same time, he would go then I would go then we would repeat the same pattern again with another officer. My husband was so nervous he got diarreah and was followed to the restroom to ensure that he had no contact with me, while I waited in the main waiting area. Anyway, out of pure anxiety I missed important details, and so did he. Bottom line, it felt more like a “criminal investigation” like you see on TV rather than a conversation to validate the marriage, though our results were successful, I was left feeling violated in so many ways and my husband was degraded and treated like a criminal but we were not in a position of power so we had to be patient and take it with a smile, any other time I would of spoke up but for this time, we were completely powerless at the mercy of someone else’s judgement call. The main complaint I have I would say would be the tactics they use, at times flat out lying about what the other person said so that you can either incorrectly agree or stop them and say that is not accurate etc. These people that conduct these types of interviews are cruel, heartless and all around take advantage of the fact that they are in a position of power to degrade, humilate and shatter the core existance of human dignity and respect. And to think that most don’t even have a college degree and are barely high school educated and their salaries are paid with our tax dollars, it is despicable.

I just had my interview in August and the lady was very firm with her questioning, but also very respectful. she encouraged us to relax and listen carefully to questions befre answering, There are some really nice people in Immigration who conduct their interviews very , firm , fair andimpartial.

  3. Hi, Roxanne. I just wanted to tell you that I completely agree with you because I had a similar, if not identical experience. My husband and I felt so humiliated, I am 29, and he is 43. We went there with the best of expectations, with all the required documents and behavior, with the only difference that I wasn’t dressed properly. Indeed, I was wearing short pants above the knee length, but after all it was over 90 degrees, it was 2 hours away from where I lived, and I had an exam that same morning, which I could not reschedule, my college enrollment depended on it, and from which I had to rush from the school, to Penn Station, NY, meet my husband, catch the train and arrive on time. This was done efficiently, and everything was fine until the moment when we entered the office of a woman, who caused an enormous damage on both of our souls. I will remember this day as the worst day in my life, when the love that I have for my husband was spitted on, because of personal ignorance and prejudices. I am going to a second one tomorrow, known as a stock interview, or fraud interview. I, the person whose goal is to have clean conscious and sleep good at night, and my husband, a creator, a painter with enormous imagination, open-minded, and liberated within. I felt like a slave who was drawn into a disbelief that good overcomes the bad. I hope I pass my interview tomorrow, because I almost got up and left the first time. I was screamed at, I was told to go back to my country twice, and my husband was treated as an unimportant unit of American value. It is sad to live in a world where people do such bad things to each other on a daily basis. This is why I feel luckier every time I have to stand against such a person, not because I wanted to be there, but because I know that no matter what happens to me I am strong enough to treat people accordingly, that means that I will not treat people with disrespect unless they have openly and directly expressed theirs. I cannot lie that I won’t tell people truth in the eyes, regardless of how much it hurts them. Yes, if I had the opportunity to tell this woman how much pain she caused me to feel, I would do it in an instance, and I would require an apology. Noone should be legally able to talk to others in such manner, anywhere in the world, and especially, America – the land of Freedom and Liberty. Welcome to America. American dream. Amin

My husband and I just went through the excruciating experience of an interview that was pretty much exactly what was mentioned above. We were treated like criminals, and i get flustered and feel like I completely messed on out of nervousness. This we on Friday and neither of us can sleep. We are reliving this horrible experience over and over in our heads an in our conversations. So does anyone know what is next? What can we expect?

    Here’s my big question? How can anyone judge what is in our hearts? We married with the intention of staying together forever.

A friend of mine who was involved in a sham marriage , she got married in vegas just one month befor her h1b visa expired things went bad from the start when the paperwork never was sent to the immigration office so she got scared of the interview process so i helped her get an annulment . My question is if she tries to do another sham marriage now after her annullment goes thru , but now her visa is expired allready . keep telling her its a big risk to her life shes been here for 12 years on a studant visa and also a h1b for 8 but her work wouldnt renew it anymore. what should she do now ?

  8. I feel sorry for your friend who spent 12 years as a student and 8 years on H1-B thats 20 years in this country and now she has to leave! The immigration lasws have Dream act for AOS for children of illegal parents and there was a law passed in 2000 or 2001 called the LIFE act for AOS for illegals who were in US for x amount of years…can’t remember how many. I knwo this bc my friend is going through a similar situation and is at a loss. Should the law have some kind of a act for people who came here as a studnet and worked legally on H1-B that they should get a chance to appy for their own Green card. Its amazing how someone else can change your life while you do all the right way! Basically the Life act was a one time thing but they still did it and got the illegals legal so why not for the ones who went the right way-the laws suck! Its seems her only option now is to be married and even if it is sham make it seem real, living with her husband etc…good luck to her 🙂 God bless

I will be going for one soon and I hate to make you go through it again, but if you can please share the details as to the uncomforatble and violated part-again I hate to ask you this but I am very very nervous now after reading some of the stories here and to think of it that we have to go through this hell when we’re in love!

  10. My experience was also as horryfying. I got married in 2002. However we did not have stable jobs so we did live separately for almost 6 months. In this period, we took in a lady who was in need of some help to settle and one thing led to another and we had sexual intimacy. The lady developed feelings for me and was adamant that we maintain the relationship which I had come around to sober up on and realise that it was immoral and not right to do. I refused and i asked her to get her own apartment. She was so mad that she accused me of harrassing her and even abusing her and she filed an Ex-Parte order in 2003. She also claimed that she was pregnant with my child which was never proven. My wife came back and I confessed to her and a after a difficult period, our lives went back to normal. My wife and I divorced in 2006 before the adjudication of my i-751. I filed a waiver of good faith marriage. When I went to the interview, the interviewer clearly made me panic intentionally. She said that “You know you are no longer married and that’s why you have brought your lawyer…..and…provide any other evidence that you have as this is your life we are talking about…” These statements spooked me out so much and leftme with a feeling that she felt that I did not deserve the green card since I was divorced though we entered the marriage based on pure love reason. I gave a her a mountain of evidence. However, a month ago i received a Notice of Intent to Deny (NOID) based on the discovery of the ex-parte order. The USCIS claims that this renders me unable to proove that my marriage was not entered in the sole purpose of obtaining immigration benefits. I have responded to the NOID and I am now playing the waiting game. Tortorous moment and I hope they reconsider.

    I’m currently on a B1/B2 visa, i have spend a lot of time in the country in the past year because my mom (who lives here and its a permanent resident) was going through a divorce and wanted to move to florida which i helped, and then i met my current girlfriend back in rhode island… we want to get married but she doesnt want to live in my country so we decided that I have more reasons to be here, so the wedding is going to take place here but i dont know what to do, if i should go back home and apply for a green card there or just stay and apply for it here… i dont want to be acused of fraud or anything and i dont want to put my future wife in that situation but if i go back home the problem is that i have to wait for a year for that process to be done… any adivise?

  14. i am in 245-i. I got my social security number, 5 years ago and the permit to work. I apply for adjustmnent os status. I worked two years with my card, inmigration renewed, but months ago, i received a notice that my sponsor declared to the IRS he did not get enough money in his business an they stopped my work permit. In 30 days, I appealed with a new sponsor ( first sponsor was as a chef, so i was told to get my new sponsor s an owner of a restaurant. I did it. Now, i am expecting for Washington answer…they can accpet my new sponsor r not. My new sposnor called me two weekes ago to let me know that he sold the restaurant. His IRS is going to reflect this..So, I am pretty sure inmigration is not going to accept him as my Sponsor. As my permit to work is stand by, is dificult to lkive here without money..so, i startedto wok in a new company. The owner wants to be my sponro, but he is not in restaurant business. He is is real state. I speak 3 languages,a and I have a degree in education in my country. Before inmigration give me a ban answer, I am trying to know which options do i have now> Can my new boss be my sponsor? Can I change my petition as a Chef, to other one, that I really know how to do it as a international sales person? Can i change sponsor? Second question: I have a fiancee and if a get married, i will have my husband as my sponsor, so this means I changed my sponsor or not? It is bad for me to marry now, meanwhile I am excpecting an answer fro inmigration..or is better for me to marry now? I am nliving with my fiancee.

  16. Annulment is acourse you would take if there was no consummation of the marriage.. if it wasnt real.

    that aside… had interview.. wife hadnt put me onlease.. wasn’t particularly worried about anything.. we did have joint other things: bank account, tax return, cable bill in my name , car insurance,… accident insurance.. love my wife no doubt.. she is kind acrazy… haha.. but she is my wife.. she ha s a hearing problem etc… anyway.. after a very tense start to an interview with a non smiling officer and the lease question came up and she didn’t like my wife’s answer when I attempted to answer because my wife wasnt hearing we were separated… then questioned separately for about an hour.. i think we did fine… no reason we shouldnt but it was just uncomfortable.. i hate thsi experience.. almost two months.. no response. case still under review.. i just hope it is routine background chekc.. love this country but will just go home if they do not want m ehere.. just hope my wife will come with me…. i really dont want to subject myself to this.. love u america… love u wifey.. but is this worth it? we shall see.

OMG then I have to wait for very intense interview, I am 43yrs old and my husband is 33yrs old I have been with him for past 2yrs and visited him overseas 4 times, just got married on 02/24/2012 and want to file I-130 for him. we love each other to death.   18. I am married to a man from Jamaica. I have been with him for 2 years. He is the absoulut love of my life and soon to be father of my child(1 month) the problem is he was previously married to a woman who went to his interview for his greencard and told the immigratioon people that they married for $$, and canceled her petition all because she was mad. They stayed together and a year later she opened a new petition and told their lawyer that she was just upset and thats why she lied and said that he married her for $$. She got mad a few months later and closed the second petition. He then went into a limbo period where his lawyer tells him just get her all he can to prove a bona fides marriage he did.. and after he and i lived together for over a year he went to court and the immigration judge gives him 30 days to leave the country. at that time i was 5 months pregnant…this has really hurt me in so many way… i went to his country and we got married after he left and i filed the i-130 and all other forms… Our son is due next month. I am just praying that everything works out and he is able to come home asap. He was not given a marriage fraud interview either i wonder why not. His Lawyers also denied the allegation of marriage fraud in court. They gave him voluntary departure because he didnt have an open petition. ugh this is my life and it is tearing both of us up! anyone know anthing about this kinda situation?

    I am sorry about what happened to you. You are probably beyond heartbroken too. It sounds like she not only took advantage of you, but she is also taking advantage of the VAWA (Violence Agaist Women’s Act.) Under this law, she does not need your permission to continue with getting her green card in the event she is abused by you.
    What I would do if I were you is contact the head of immigration in your district and write a letter. Let them know that this was the woman of your dreams and that you never abused her. That you know now that she was taking advantage of you for your nationality status when she suddenly one day called the police and falsely accussed you of abusing her, then she took the money and filed false police reports. (We don’t need any more people like this here in the USA!) I would follow up with a letter to your senator as well and they will folllow up with the USCIS. They will then consider all of this when she goes for her solo interview and then they will probably deny her a green card. But you will have to act quickly and do the above. It sounds like she is a very good actress as well. Good luck to you.

  22. I have a friend madly in love with a Mexican friend. He came to the US from Mexico in 1989 on a visitor’s visa. He wanted to stay in the US so he found a woman to marry him solely for the purpose to obtain a green card. After they got married they went their separate ways. He also committed himself to pay this woman $350.00 a month for this service of marriage. Isn’t this fraud and conspiracy on both parts? He has now met this friend of mine and they want to marry. My friend helped him get a divorce because they couldn’t find this woman he married. My friend is now helping him study for his US citizenship. What would be your advice for my friend? Sarah

  24. My friend married an American citizen and he came to USA. He was on temporary green card for two years. After this two years, there was some problems between and he was about to be deported by the wife’s family. This created a gap for permanent green card. so, he got the permanent green card one months ago after living with her for almost five years. This wife got MS and is unable to do anything it is being for about 3 years now. So, he would like to do couple things but not sure if he can since he got the green card one month ago. 1) can he divorce her or can he get divorce? 2) can he put her in nursing home?

  25. I went for my AOS interview yesterday 10/16/2012 in Pittsburgh, PA.
    it was a hell. We were interviewed together and later separately. Our answers were the same 95% or above. I told my wife how USCIS officers are acting each time we talk about AOS she always say never would they do that. She was questioned heavily. Lol At the end of the interview, the IO said Im sorry people do come here with fraud marriage and that’s what we do here. To cut the story short, the questions were too deep, she dug deep into our marriage life. She later said we will get back to u in mail. Almost all couples were interview the same way yeste. Im waiting for them. Whatever the outcome, life goes on. But only one thing lm concerned about is my wife, she is the best woman on earth. Separation is indeed a bad thing.

  26. I ‘ve been with my man from 2001 -2009 but not married yet; just living together. We have no children together. I have 3 from ex. In 2010 we married! The toll of his need for his papers were so much heavy wieght on me & in the marriage. I felt that he was only wanting his papers cuz his persona changed so bad. He became hateful towards me & my kids.

    Well needless to say before we married we had our seaperations a few times before & he met another woman. He would argue & want to be with the other woman. So i would c them together in a car pass by. Everytime we were apart. I know everything about her. Still during our marriage they would c each other.

    Now 2012 I filed a divorce. He took everything from me & the kids. I want to fight for cars & anything i can. Can I get spousal maitenance or alimony? We were married in TEXAS!

    We had interviwes in san antoino but I didnt show up to none of them> Should i go to one of them and tell them my side or what should i do? I love my husband but deep down I know he dont feel the same for me. I file as I-130 FOR HIM. What should I do????

    Is it to late to put in for the spousal support oe alimony towards my divorce. I filed it pro se. I dont have any money or im not working. For years he was the one who supported the family. I have no work history or school.

  28. Wow, you people are bless. A friend of mine is having a serious problem presently. She met this christian guy and after few months he asked her to marry him because he didn’t want to loose her due to his immigration status. He promise for them to make it official to her parents but now things are not working right. He also travel to Africa with the intention that he was going to let his parents know about this girl but since he got back things are even worst. Since they got marry in the court, they never live together or even have sex because my friend didn’t want to until the church wedding is done, and now this man bringing all the excuses you can ever imagine.   31. There are as lot of people who marry for money. My ex boyfriend is doing this I believe. He got engaged in Mexico last year when he was still with me, I had no idea! We broke up after he came back and two months later I found out he was marrying a 19 year old! I was so hurt. I still believes we were going to get back together. The whole year we are together like we had been, I thought maybe it was all a lie. Then toward the end of the year he told me he was only doing it so they could of pay him. I wish I could have called a number to report th this I was so angry. He tried to be nice to me and then I think him being scared I was going to say somethin g he started sayin he fell in love blah blah blah. Thing Is he is married thru the church her e and I heard he married to church down in Mexico, so his marriage is not valid. I hope uscis catches these two.   32. Hi. I’ve been married to US citizen and I got my work permit few days ago. Before our marriage she admitted she have been in prison for using drugs and she stopped to use them since them. About 2 month after our marriage she confessed that she has been using drugs all the time(and she won’t use them anymore), now 2 month later she is confesses again, that she did not stop them. Basically I wished her to be open with me, I want to have kids and have a family with her. But I can’t do it anymore. It’s just too much, she is addicted to them very much. Even these days, she was doing it in front of me by my request, 2 days now… I’m willing to go and help her to get off the drugs, but I will not last long. What can I do if I file a divorce and will I be reported, will be a lawyer necessary a good one and expensive. I would very like any opinions, should I better wait 1 year till i get an unconditioned green card and pray God with love and support if she can get out of the drugs, and if not(she can not get out of drugs) divorce her after the green card or divorce her now(I’ll give her 2-3 month).   34. My husband’s ex wife is already a citizen here in america and enjoying every benefits she could get. She also receiving monthly child support form my husband.She also took all the money from the bank of my husband , wiped out all the properties and now is harrassing my husband to give more and more money for the kids. Out of nothing we intend to look for her record in the Statistics in the Philippines and we have found out that she was married twice. And my husband is her second marriage. In the Phil., there is no divorce, and the marriage were never been nulled, my questions is. Does my husband has a grounds to file a complain? if yes, whereto file?? What are the requirements? Cause we have Certificate of No marriage and National Bureau of Investigations track records of the surnames she used in her nbi clearances. what about the properties her and my husband bought, she already named all the property only to her when she have found out that were about to marry, Even brag about my husband’s life insurance too, to just give it to her 2kids. Can we also ask her to change her name not to carry my husband last name.

  35. My boyfriend for 4 years and I are planning to get married. He was married before and file a petition for greencard for the ex wife but the petition was later denied. He filed a divorce and got the final judgment about a month ago. He is worried that if he will file a petition for me, the USCIS will see that he filed a green card petition before and was denied. Would that affect our application later on?

I had the interview for adjustment of status amazing they pulled up the imformation from my prints i was trying to hide.I used another name and the officer asked me who is that i said its a friend.I know i made some mistake in the interview.She was very firm and trying to find fault with our marriage.i got arrested on the other name i guess they pulled it up from my prints it was a nother person identity.I didn`t know the person had a drug warrant but they let me go because i didn`t match that person.Now i have 30 day to submit the i-72 form with proof from the court on what happened to the arrest.I am ewi and second marriage this stuff have put alot of stress on me and my wife but she is supportive we .We wondering if this office can put me in removal for the mistakes i made.They gave me a work permit with advance parole i guess this don`t mean anything because they can cancel it when ever.i don`t have any criminal record in my own name just the name i used.I hope everYthing goes well and my God deliver me from immigration mess.Any advice will be appriciated.

  37. I am sorry for what have happened to each of you. I truly love my husband but just today I got a called from his lawyer stating that he has filed for a divorce. The catch is that we have been married for five years this month June but he ask me for one five years. We have not been together in a long time. But when he got sick he came over and I took my time and went to the hospital and gave h the care a wife should give there husband. It was only a short time that he was there again as soon he was well he left again. I feel as though he only married me to state here in the states. My kids are crazy about him but he just ignore them. They are not his kids there father have died. My youngest call him daddy. He really try to get in touch with him because he wont my husband to be in his life. My husband was never there what rights do I have for not letting him stay here in the state now that he wants a divorce.

  39. Hello. I was married to US citizen for 2 years. But after we filled I-751 jointly and after month my US citizen wife told me she filled for divorce which made me schok . She didn’t want tell me why but later on I found out she had a boyfriend. So we divorced without fighting. But our lawer didn’t told us to send the divorce copy to immigration now I receive a letter about interview for conditional removal. However it says my ex wife also have to be there. Unfortunately her boyfriend against to that. So what should I do? If she doesn’t come will that couse me problem? Or should I talk again with her boyfriend and take her to the interview? Me and my hudband got married in 2010 and shortly after married he left for el salvador cuz his mother was ill and we filed petition i-130 was approved and then we had an interview in el salvador then his petition was denied i appealed it and they said marriage wasnt bonafide so it was revoked idk what to do if there is anything i can do need help

  41. The immigration system is a joke. No problem with the interview but I learned soon after that the wife (now ex) was only after a green card and citizenship. As soon as she was denied citizenship she was like “I’m outta here”. Ofcourse that was after spending all my savings to open a business which she diverted all the funds to a private account. So no, its probably not anything the interview could have caught. However, after everything was said and done, I found out she had five theft convictions (one before she even filed for the green card) and never mentioned these on the application. In addition, she was on a 3 year overstay having arrive on a student visa but never went to school and, instead hopped around the country working illegally. So you might figure hey, 1) not reporting her first conviction on the green card application, 2) never attending any school on student visa, and 3) four additional convictions for theft surely ICE would do something. Even though they have all the evidence nothing has been done. With a little digging they could have uncovered the student visa fraud and the first theft before issuing the card. But the US doesn’t seem to have as much concern for the safety and security of its citizens as much as concern for the “rights” of the fraudulent immigrant. So when I hear that they are checking things more thoroughly I say GOOD, I wish they had been more vigilant in my situation.

  42. My husband and I have been married for almost 5 years. We live and work together, and have everything under both of our names: cars, bank accounts, credit cards, bills, etc.. all of it. We submitted our I-485 in Nov of 2011. In Feb of 2012 we had our first interview, and in Aug 2012 they came to the house to do a home inspection. We didn’t hear anything for over 2 years, and finally they called us in for a second interview in May 2014. We have given them everything we possibly could, including over 100 pictures, and they still conducted a horrible fraud interview on us. Not once, but twice. We just had a THIRD interview this past Friday. My question is – has anyone else been through this? They have not given us an answer, and have not said why they are conducting a fraud investigation. I’ve read multiple things on the internet and I have not come across a case where a couple had to go through 3 interviews, especially two fraud interviews.

  43. i just went to interview today…my husband was acting funny, He was acting like he didnt know anything about me. Whats frustrating me is, ive been in this marriage truthfully, i never went into this for green card, i would have married someone else a long time ago if it was just for green card, i met this guy and i loved him.And i thought i could be with him, …Today he was not even answering the questions right, all jokingly through out and all wrong answers…what was a final blow was when the officer realized i was not even on his medical insurance, He is a 2nd Lieutenant and he never mentioned that i could benefit from this, Hospital letters have been piling up He never said anything…and that was one of the things that made our marriage look so fake..And the lady was not nice at all, and she told us we might be called for second interview, and that we should wait for a letter/notice for this.
    i am so heart broken i dont know if this guy did this purposely, because when we were there He started to tell me what a bitch i am to him, and that i am using him for papers…i really dont know the person i married.Please help me understand what 2nd interview mean, and what i have to do in this kind of thing…we have been together since May 2012, and we got married last year september,. last week we had a huge fight we had fight, He gave me an STD, i have never cheated on him ever. and he does not even want to go to the doctor…..He once hit me and he broke my finger, and he wanted to hit me today , when i asked him why he came after me, after i had left him last year…before we got married, and he got a half a million dollar settlement 2 and half months ago., I dont know if this is what changed this guy, or he just wanted to mess things up for me…i never wanted his money and today i was suppose to sign a contract for a show on Broadway…Please help 🙁
