IMMIGRATION INSIGHTS

Question: I entered the United States through ESTA or the Visa Waiver Program and received an H-1B job offer. Can I change to H-1B status without leaving?

Short answer: Generally, no. A person admitted under the Visa Waiver Program is ordinarily ineligible to change to H-1B status inside the United States under INA §248 and 8 CFR §248.2. A job offer or pending petition does not itself extend the person’s authorized stay, grant H-1B status, or authorize employment. The facts and any narrow statutory exception must be assessed separately.

Can an employer file an H-1B petition?

An employer may be able to file an H-1B petition requesting consular notification rather than a change of status, if the employer, position, and beneficiary meet the H-1B requirements and a cap or exemption issue is resolved. Approval of the petition is not the same as H-1B status. It does not issue an H-1B visa, extend the Visa Waiver Program admission, or authorize the person to start H-1B employment while still admitted as a visitor.

The person must comply with the current admission and depart when required. After petition approval, a person who needs an H-1B visa generally must apply at a US embassy or consulate and, if the visa is issued, seek admission in H-1B classification. A visa does not guarantee admission; US Customs and Border Protection makes the admission decision at the port of entry.

Where should the H-1B visa interview be scheduled?

The Department of State updated its nonimmigrant visa interview-location instructions on July 15, 2026. Applicants generally should schedule in their country of nationality or residence, or at a designated processing post when applicable. Applying elsewhere may make qualification more difficult and may involve longer waits and nonrefundable fees. Check the current instructions for the relevant embassy or consulate before arranging travel.

Read the Department of State’s visa interview-location guidance.

What should be checked before filing?

  • The I-94 or electronic admission record and the last day of authorized stay.
  • Whether the offered position and employer qualify for H-1B classification and whether the annual cap applies.
  • Whether the petition should request consular notification rather than change of status.
  • Visa requirements, interview-location instructions, and the timing of departure and return.

Do not assume that a pending or approved H-1B petition allows a Visa Waiver Program entrant to remain in the United States after the authorized admission ends. Filing and travel decisions should be made before that deadline, based on the actual admission record and petition strategy.
