A finding can have long term consequences, so the precise statement, the surrounding record, the intended immigration benefit, and the agency that made the finding all matter.

Fraud and willful misrepresentation are related but different

USCIS distinguishes fraud from willful misrepresentation. A willful misrepresentation finding generally requires a false representation that was willfully made, was material, was made to a US government official, and was used to seek an immigration benefit. “Willful” does not necessarily mean that the person intended to deceive the officer. A fraud finding requires additional elements, including intent to deceive; for a completed benefit, it generally also requires that the official believed and acted on the false representation. See the USCIS Policy Manual’s fraud and willful misrepresentation guidance and its adjudication guidance.

Not every inaccurate answer or document establishes inadmissibility under INA §212(a)(6)(C)(i). The analysis can turn on whether a representation was actually false, whether it was willful, whether it was material, whether it was made to a US government official, and whether it was made to obtain an immigration benefit. The governing legal standard and available evidence must be applied to the particular record.

How to challenge a fraud or misrepresentation finding

The available review procedure depends on who made the finding and where the case stands. A consular refusal, a CBP determination, a USCIS decision, and a finding in removal proceedings do not necessarily have the same review route or deadlines. There is no single reconsideration procedure that applies to every agency and every case.

A focused review ordinarily begins with the written refusal or decision and the underlying record of the alleged statement. The legal analysis should identify the exact statement, its context, whether it was attributable to the applicant, the evidence of willfulness, the materiality issue, and the connection to the requested immigration benefit. If the record does not establish one or more required elements, counsel can assess the appropriate agency specific challenge. Processing times vary; old estimates of a two week or 30 day resolution should not be treated as current service commitments.

Immigrant waiver under INA §212(i)

INA §212(i) provides a discretionary waiver of the fraud or willful misrepresentation ground for certain immigrant applicants. Under the ordinary statutory route, the applicant must be the spouse, son, or daughter of a US citizen or lawful permanent resident and must establish that refusal of admission would cause extreme hardship to a qualifying US citizen or lawful permanent resident spouse or parent. A child of the applicant is not an ordinary qualifying relative under this provision, although hardship to a child may be relevant to the extent it affects a qualifying spouse or parent. VAWA self petitioners are subject to separate statutory provisions.

Eligibility for a waiver is not the same as approval. The application must establish the statutory requirements and warrant a favorable exercise of discretion. Evidence should be tied to the actual qualifying relative and the claimed hardship, and the legal theory should account for any other inadmissibility grounds.

Separate relief under INA §237(a)(1)(H)

INA §237(a)(1)(H) is a distinct waiver of certain fraud related deportability when a person was inadmissible at the time of admission because of fraud or misrepresentation and meets the statute’s additional requirements. It is not a second ordinary consular immigrant visa waiver and should not be treated as interchangeable with INA §212(i). Whether it applies depends on the person’s admission history, documents, qualifying family relationship, and procedural posture. See the current text of INA §237(a)(1)(H).

Nonimmigrant waiver under INA §212(d)(3)(A)

Some applicants seeking temporary admission may request a discretionary waiver under INA §212(d)(3)(A). This route is separate from the immigrant waiver under INA §212(i), and it is not available for every inadmissibility ground. The statutory exclusions, requested nonimmigrant classification, purpose of travel, and relevant agency procedures must be considered. See INA §212 and the applicable Department of State or DHS guidance.

The firm has achieved successful reconsideration and waiver outcomes in immigration matters. The appropriate strategy depends on the exact representation, the evidence, the adjudicating agency, the available procedural route, and whether the applicant meets the requirements for relief.

Please contact Messersmith Law Firm at 305-515-0613 or info@messersmithlaw.com to discuss a fraud or misrepresentation finding.

INA §212(a)(6)(C)(i) makes a noncitizen inadmissible if, to obtain a visa, other documentation, admission, or another benefit under the Immigration and Nationality Act, the person commits fraud or willfully misrepresents a material fact.
