{"id":1160,"date":"2023-07-26T19:57:30","date_gmt":"2023-07-27T01:57:30","guid":{"rendered":"https:\/\/blog.messersmithlaw.com\/?p=1160"},"modified":"2026-08-15T23:19:02","modified_gmt":"2026-08-16T05:19:02","slug":"proclamation-10043","status":"publish","type":"post","link":"https:\/\/blog.messersmithlaw.com\/?p=1160","title":{"rendered":"Proclamation 10043"},"content":{"rendered":"<p><strong>Proclamation 10043 &#8211; Suspension of Entry as Nonimmigrants of Certain Students and Researchers From the People&#8217;s Republic of China<\/strong><\/p>\n<p id=\"p-4\" data-page=\"34353\">The entry into the United States as a nonimmigrant of any national of the PRC seeking to enter the United States pursuant to an F or J visa to study or conduct research in the United States, except for a student seeking to pursue undergraduate study, and who either receives funding from or who currently is employed by, studies at, or conducts research at or on behalf of, or has been employed by, studied at, or conducted research at or on behalf of, an entity in the PRC that implements or supports the PRC&#8217;s \u201cmilitary-civil fusion strategy\u201d is hereby suspended.<\/p>\n<p id=\"p-4\" data-page=\"34353\">Some applicants were refused visa or entry pursuant to Proclamation 10043 were also found to be inadmissible pursuant to <a href=\"https:\/\/messersmithlaw.com\/ina-212a6ci\/\">INA 212(a)(6)(c)(i) Misrepresentation<\/a> \u00a0or <a href=\"https:\/\/messersmithlaw.com\/ina-212a1aiii\/\">INA 212(a)(1)(a)(iii) Physical or Mental Disorder<\/a>.<\/p>\n<p><a href=\"https:\/\/messersmithlaw.com\/ina-212a6ci\/\"><strong>INA 212(a)(6)(c)(i) Misrepresentation<\/strong><\/a><\/p>\n<p>This provision of the Immigration and Nationality Act (INA) prohibits the admission of any alien who has misrepresented a material fact in order to obtain a visa or other immigration benefit. This includes individuals who have lied about their educational or employment history, their ties to the PRC, or their involvement in military-civil fusion activities.<\/p>\n<p><a href=\"https:\/\/messersmithlaw.com\/ina-212a1aiii\/\"><strong>INA 212(a)(1)(a)(iii) Physical or Mental Disorder<\/strong><\/a><\/p>\n<p>This provision of the INA prohibits the admission of any alien who is mentally or physically unable to care for themselves or who is likely to become a public charge.
